These Terms of Service (“Terms”) govern your access to and use of the tourismtribe.ai website and AI tools (“Services”) operated by Tourism Tribe Pty Ltd (“we”, “us”, “our”). By accessing or using our Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organisation. By using our Services, you confirm that you meet these requirements.

2. Account and Access

  • Some tools require you to provide your name, email address, and business details to access them.
  • You are responsible for keeping your login credentials secure.
  • You must not share your account access with unauthorised parties.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of AI Tools

Our AI tools (including Robin, Marketing Mate, Review Milker, ATDW Profile Optimiser, and the AI Readiness Scanner) are provided to assist you with your tourism marketing and operations. When using these tools:

  • Your content: You retain ownership of any content you input into our tools (such as business descriptions, reviews, or ideas). By submitting content, you grant us a limited licence to process it through our AI systems solely to deliver the tool’s output to you.
  • AI-generated output: Output generated by our tools is provided for your use. You are responsible for reviewing and editing AI-generated content before publishing it. We do not guarantee that AI output is accurate, complete, or free from errors.
  • No guarantees: AI tools produce suggestions and drafts, not professional advice. You should not rely on AI output as legal, financial, or medical advice.
  • Fair use: You agree not to use our tools to generate content that is unlawful, harmful, misleading, or infringes on the rights of others.

4. AI Readiness Scanner

The AI Readiness Scanner analyses publicly available information from the website URL you provide. By submitting a URL:

  • You confirm you have the right to request a scan of that website (e.g. it is your own business website or you have the owner’s permission).
  • The scan results are delivered to the email address you provide and are intended for informational purposes only.
  • Scores and grades are based on automated analysis and should be treated as guidance, not a definitive assessment.

5. Intellectual Property

  • All content, branding, software, and materials on tourismtribe.ai are owned by Tourism Tribe Pty Ltd or our licensors.
  • You may not copy, modify, distribute, or reverse-engineer any part of our Services without our written permission.
  • “Tourism Tribe” and “TourismTribe” are trademarks of Tourism Tribe Pty Ltd.

6. Fees and Payment

  • Some of our tools and services are free. Others require a paid subscription or one-off payment.
  • Pricing is displayed at the point of purchase or sign-up. All prices are in Australian Dollars (AUD) unless otherwise stated.
  • We reserve the right to change pricing with reasonable notice.

7. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

8. Limitation of Liability

To the maximum extent permitted by Australian law:

  • Our Services are provided “as is” without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of our Services.
  • Our total liability for any claim related to our Services is limited to the amount you paid us in the 12 months preceding the claim, or $100 AUD, whichever is greater.
  • Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

9. Acceptable Use

You agree not to:

  • Use our Services for any unlawful purpose.
  • Attempt to gain unauthorised access to our systems or other users’ accounts.
  • Use automated scripts or bots to access our Services without our written permission.
  • Submit content that is defamatory, obscene, or infringes on intellectual property rights.
  • Interfere with the proper functioning of our Services.

10. Termination

We may suspend or terminate your access to our Services at any time if you breach these Terms. You may stop using our Services at any time. Upon termination, any licences granted to you under these Terms will cease.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
